JDKJ agrees with the Florida AG that this is a pre-requisite to holding any position, whereas I argue that as it's written, is clearly a requisite to *keeping* a position once appointed (it's a pre-requisite to fulfilling certain duties on the job, but seems to have been written as a mechanism for justifying termination). The only time I agree that it's a pre-requisite is when someone is running for office (it's needed to be listed on the ballot).

While the OoL is required for judges to be eligible for election, Tunis was appointed to her current position in 2005, and the fact that she may have been ineligible for re-election in 2003 (to a position she was appointed to in 2000) has no bearing on her current position, since Circuit Court judges don't need to be current sitting judges in order to be eligible for appointment. And the Florida Bar does not require you to have a valid OoL signed in order to maintain your Bar license.

Tunis is up for re-election, but now that she's signed her OoL, is eligible to have her name put on the ballot.

I think we've also fully vetted the idea that the OoL is a relic from the McCarthy era, but I still believe that even if it were relevant and a valid requirement, it's meaning is not as the AG interprets (and I also argue that his interpretation is limited to comments on cases where elected officials were involved, so his interpretation is modified by the fact that he's commenting on clearly worded sections of the act as opposed to vaguely worded ones).
