Former University of Nebraska quarterback Sam Keller is heading to Pasadena, California this week to watch his lawyers argue before the 9th U.S. Circuit Court of Appeals. Keller's lawyers will appear before the appeals court to argue that a lower court decision that EA and the NCAA should not receive special protection under the first amendment and that Keller's lawsuit should go forward should be upheld.
The appeal is the result of a February 2010 decision by U.S. District Court Judge Claudia Wilken. In that case, the judge refused to give EA "free speech protection" and to dismiss the lawsuit.
"When you are playing, you are kind of naïve to the idea that you are being taken advantage of because you are so caught up in playing college football," Keller told the Associated Press.
