A federal court judge has denied Zynga's motion to dismiss a class action lawsuit. The suit will move forward because Zynga's position was deemed weak by the court. Lead plaintiff Rebecca Swift claimed in December that ads on Facebook promising free virtual currency for Zynga games had led to unauthorized payments.
Zynga asked that the lawsuit be dismissed on the grounds that it could not be held responsible for content generated by a third party. Judge Sandra Armstrong disagreed, saying that the plaintiff had "sufficiently alleged" Zynga's role in the creation of the ads, which exposed it to the lawsuit. The judge also refused to dismiss the suit against Adknowledge, Zynga's advertising partner and a co-defendant.
