Take-Two Files Duke Suit Against 3D Realms

Bloomberg is reporting that Take-Two Interactive is suing Apogee Software, Ltd., the formal business title of 3D Realms. The publisher is taking legal umbrage that the developer failed to deliver Duke Nukem Forever. 3D Realms infamously was developing the fourth game in the Duke Nukem series for over a dozen years before dissolving earlier in May.

"Apogee continually delayed the completion date for the Duke Nukem Forever," said Take-Two said in the suit. "Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever."

Take-Two says that it paid 3D Realms $12 million for the Duke Nukem Forever publishing rights in 2000. A second agreement was apparently forged in 2007, though no specific dollar amount was given.[/QUOTE]
