A while back a judge decided that he didn't have to reveal goings-on in a meeting with energy folks because he had executive Privaledge, but now he claims he isn't part of the Executive branch (although he had no problem with co-operating with these guys pre-2003). So what is he? A rogue nation?
Article 2 section 1 lumps the Pres and Vice Pres in as the Executive Branch, but Dick Cheney's copy has an amendment saying that he is his own branch I suppose.
I think the whole reason behind this is that he and his office haven't been too careful about state secrets. We all know about the Valarie Plame affair, who knows what else he has leaked? Maybe he let Al Quida know about our plans in Iraq ahead of time?
