The split panel upheld an Alabama law -- nearly identical to one in Georgia -- that made the sale of sex toys a crime punishable by up to a year in prison.
The decision extends an emerging division in the court over sexual rights, with Judges Stanley F. Birch Jr. and Rosemary Barkett leading opposing factions.
Birch maintains that although the U.S. Supreme Court last year struck down a Texas law criminalizing homosexual sodomy, the justices have not decided fully that sexual privacy is a fundamental right protected by the Constitution.
Barkett claims that the court is refusing to apply the sodomy decision to laws that violate people's right "to be left alone in the privacy of their bedrooms."
Last week, the full 11th Circuit split 6-6 in denying reconsideration of a decision that upheld a Florida law prohibiting homosexuals from adopting children. Birch wrote that while he thought the law was "misguided," since there was no "constitutional liberty interest in private sexual intimacy," the court must uphold Florida lawmakers' right to exclude gays and lesbians from adopting.

History fails to attribute to patriot Patrick Henry the statement "Give me sex toys or give me death," so therefore it's not surprising that the legal battle continues over whether the right to obtain and use appliances intended for sexual gratification is included within the liberty protected under the U.S. Constitution.
A number of states still have laws that make it a crime to sell or distribute sex toys, and over the past several years there has been a notable amount of litigation throughout many southern states concerning whether these laws remain constitutional in the aftermath of the U.S. Supreme Court's ruling in Lawrence v. Texas, which holds that states cannot outlaw homosexual sodomy between consenting adults.
The 11th U.S. Circuit Court of Appeals -- the federal appellate court that hears appeals from Alabama, Florida and Georgia -- has in recent years become a veritable hub for sex toy–related litigation. In July 2004, the 11th Circuit examined whether an Alabama law prohibiting the sale of sex toys violated a purported constitutional right to sexual privacy. By a vote of 2–1, the court rejected the challenge to the Alabama law.

The owner of two adult novelty stores in Alabama, said she has only one legal challenge left to the state’s 1998 law banning the sale of sex toys.
If that fails, plaintiff Sherri Williams, owner of Loving Enterprises, said she’ll remove the toys and stock the shelves with legal pornographic videos and DVDs.
On Tuesday, the U.S. Supreme Court denied her request for a hearing in her lawsuit against the state, but the law will not be enforced pending the final outcome of the case. After seven years of contradictory court decisions, Williams said she was disappointed with the high court’s decision.
“It’s such a roller coaster,” Williams said. “The lower and higher courts don’t agree. One court says the government shouldn’t intrude and one says, ‘yeah, we should.’ “
“Should the day come that I have to yank all the toys out of my store, I’ll just fill it with adult videos. It’s illegal to sell toys, but you can sell porn all day.”
On appeal to the Supreme Court, Williams and the American Civil Liberties Union argued that a ruling in Lawrence v. Texas, which overturned a law banning gay sex, also protects the privacy of people who purchase and use sex toys.
Six other states—Georgia, Mississippi, Indiana, Texas, Louisiana and Virginia—also outlaw the sale of sex toys.
