My idea is simple. If a law is deemed unconstitutional, then a special investigation will be launched to see if the politicians involved in the law's passage knew that it was unconstitutional in the first place. If so, they are formally charged with legislative fraud, a federal offense, and enjoined from holding public office. The commission would then hold a special election to find replacements for the politicians involved. Our schools are saying that the Constitution is the "supreme law of the land." I think it should be enforced that way.

To what extent will it be determined that the politician purposely tried to pass a law that is unconstitutional? A lot goes into making a purposed bill into law. Blaming one individual on the bill's failure is kind of careless. When that politician is voted into office to represent the population and perform actions with what they believe is in the country's best interest.
Now do we have politicians that do this, no. Many politicians are swayed by lobbyists and special interest groups. And though it may not be the fairest method to get what you want out of the government it does work.

Definitely wouldn't work unless it was passed as an Amendment, and then you would have to prove intent to pass an unconstitutional law, with complete foreknowledge of how the courts would rule it.

I see where you are going with your idea, but must strongly disagree. Protecting video games is protecting free speech. If we try to limit legislation, we limit their free speech (regardless of how cooky it may be).

Yeah, as much as I would like to punish politicians, they are more slipperly and weasely than any criminal. The only way to truly punish them is to take them out of office. Even though they'll still probably get a cushy job as a lobbyist... That's the best you can hope for.

There is something even better than removing them from office, and that is exposing them! What politicians have it the worse? Those who are exposed. Marion Berry and his drug issues, Mark Foley and his little kid issues, etc. Expose these people for their needless waste of money. It is their right to use their voice, however it is our right to reciprocate.

Yep it is one of the best ways to take them out. Of course an even better way would be to de-elect congress and send an entirely Freshman Congress in with a mandate to out law lobbyists.

Or, have a President that wants to outlaw lobbyism (not Hillary).

I thnk I understand the reasoning behind this but I don't agree simply because for a bill to pass into law it must undergo several level of ratification (either at a the State or Federal level) and be agreed upon by a majority. Reguardless of the law's initiator(s) motivations. Now if those initiator lied about pertinent facts reguarding the initial Bill in the first place, then they would be guilty of that, but wouldn't you also have to pass some of the blame on to the other legislators involved in passing the unconstitutional law for not performing do dilligence in researching it?
Besides from our history the idea of what is and is not considered unconstitutional can change. That's why the placement of supreme court judges is such an important part of our system of checks and balances.
Again I understand the desire to add a mechanism to our politcal system that would help catch those that use there position for personal gain or to further political ends but I'm not sure if this is the way to do it.
